Contest Overview: Contest open to legal residents of the 50 United States, District of Columbia, and Canada, who are 18 years or older, and who have a valid PayRange App account. No purchase necessary. Sponsor “PayRange”.

Contest Entry Period: The Contest begins on 7 March 2023 at 12:00AM PT and ends at on 18 April 2023 at 12:00AM PT (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible.

How to Enter and Eligibility: iheartPayRange (the “Contest”) is only open to entrants who have a PayRange App account, are 18 years or older, and legal residents of the 50 United States, District of Columbia, and Canada. The “Contest” can be entered in two ways. The first way to enter the Contest is by uploading a photo to your Facebook, Twitter or Instagram account, tagging @PayRange, setting the post as “public”, and by commenting to “why do you love PayRange” in the post. For those who select not to enter the contest using their Facebook, Twitter or Instagram account, entrants can upload a photo and comment to the Contest website at www.iheartpayrange.com. By uploading a photo and a comment to the Contest website, you understand and agree that the Sponsor shall have the right, without limitation, to repost your entry to the Sponsor’s Facebook, Twitter or Instagram account. In addition,  by entering your content (e.g., photo, comments, text, etc.), you understand and agree that the Sponsor and anyone acting on behalf of the Sponsor or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, likeness, image, statements about the Contest, for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

The entry must fulfil all requirements of the Contest, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications of the Contest may be disqualified at the sole discretion of the Sponsor. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Contest, your submission may be disqualified at the sole discretion of the Sponsor. Employees, officers, directors, and agents of PayRange (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the contest. The Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

Agreement to Rules: By entering the Contest, the contestant (“You”) agree to comply with and abide by these Rules and the decisions of the Sponsor, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the Sponsor’s decisions as final and binding as it relates to the content of this campaign. Entrants should look solely to the Sponsor with any questions, comments or issues related to the Contest.

Rules: Photos and comments submitted must be your own photo and comment; photos that show anything that violated PayRange ‘Contest’ rules will automatically be disqualified.

Winning Criteria: Entries will be evaluated on how the entry, “your story (photo + comment)”, inspires us…, moves us, and perhaps even touches our souls.

Prizes: Winners will be selected after “Sponsor” and/or Sponsor Representatives review user submissions and evaluates submissions against contest criteria stated above. The winner(s) of the Contest (the “Winner”) will receive the following prizes:

• One grand prize winner will receive free purchases for a year, paid out as a total of 250 free purchases credited to the winner’s PayRange account, valued at up to $4 each.
• Nine (9) additional winners will free purchases for a month, paid out as 25 free purchases, credited to the winners’ PayRange account, valued at up to $4 each.

All winning free purchase credits will expire on April 18, 2024. In the event free purchase credits are not used by the expiration date, the credits will be void. The credits are not redeemable for cash nor transferrable.

Each free purchase credit allotted is valued up to a transaction value of $4.00, and any unused portion per transaction does not roll over to other transactions.

The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution shall be permitted except for at the Sponsor’s discretion. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by the Winner is not permitted. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner. Acceptance of the prize constitutes permission for the Sponsor to use the Winner’s name, likeness, photo, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

Prize Winner Notification/Verification: The Winner will be selected by the Sponsor. All potential Prize winners must comply with these Official Rules as published to be confirmed as an official winner and accept their Prize. The potential Prize winners are not official winners unless and until Sponsor confirms such. The potential Prize winners will be notified via a direct message to the winners’ Facebook, Twitter or Instagram account on or within thirty (30) business day after the applicable Contest End Date or through the provided email address for entrants who submitted their entry through the Contest website. All Prize winners must provide the Sponsor their PayRange user ID and email. If in any instance, notification attempt(s) to obtain winner’s PayRange user id and email fail, or if a potential Prize winner is found to have not complied with these Official Rules, the applicable Prize will be forfeited, and an alternate potential winner will be selected from among remaining eligible Entries received for the applicable Entry Period.

In the sole discretion of the Sponsor, the Entry photo and comment must NOT:

• Contain language that violates or infringes upon another’s rights, including but not limited to privacy, publicity, or intellectual property rights (including, without limitation, trademark or copyright infringement), without permission.
• Disparage Sponsor or its products or services, Sponsor’s competitors or their products or services, or any other person or party affiliated with the contest.
• Promote company names, product names, brand names or trademarks other than those owned or posted by Sponsor, which entrant has a limited license to use for this contest.
• Contains the names, likenesses, or other indicia identifying any celebrities and/or other public or private figure, living or dead, without permission.
• Contain language that is inappropriate, indecent, obscene, profane, hateful, tortious, defamatory, slanderous, controversial or libelous.
• Contain language that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.
• Contain, or contain language that promotes, (a) pornography, adult-oriented content or any other sexually explicit material; (b) dangerous stunts; or (c) real weapons of any kind including, but not limited to, guns, knives or projectiles;
• Contain language that is unlawful, in violation of or contrary to applicable laws or regulations; and/or
• Contain language in which the Released Parties (as defined below) do not wish to associate themselves with, in their sole discretion.

Intellectual Property Rights: You acknowledge and agree that you do not acquire any ownership or other rights in proprietary information and materials of PayRange by authorizing use of your User Content or otherwise using or accessing the PayRange website or social media accounts.

Rights Granted by the Entrant: By entering your content (e.g., photo, comments, text, etc.), You understand and agree that the Sponsor and anyone acting on behalf of the Sponsor or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this content, you represent and warrant that your entry is an original work of authorship and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of the Sponsor. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless PayRange from and against any suit, proceeding, claims, liability, loss, damage, costs, or expense, which PayRange may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

Terms and Conditions: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Contest for any reason or no reason. The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the should virus, bug, non-authorized human intervention, fraud, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such cases, the Sponsor may select a winner(s) from eligible entries received before and/or after the action taken by the Sponsor if appropriate. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions. The Sponsor has the right, in its sole discretion, to maintain the integrity of the Contest, to void entries for any reason, including, but not limited to: entries that do not align to the Contest photo and comment rules. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.

Limitation of Liability: By entering the Contest you agree to release and hold harmless PayRange and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorized human intervention in any part of the Contest; (iii) electronic or human error in the administration of the Contest or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.

Disputes: By participating in this Campaign, you agree that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the State of Oregon. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering the Contest). You further waive all rights to have damages multiplied or increased.

The Contest is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks that are used to share the Contest. You understand that you are providing your information to the owner of the Contest and not to Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks.
